1.The development must be begun not later than three years beginning with the date of this permission. The reason for the condition is :- The time limit condition is imposed in order to comply with the requirements of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2.The development shall be carried out in accordance with the application form and approved plan received by the Local Planning Authority on 9 December 2015. The reason for the condition is :- For the avoidance of doubt.
3.The use hereby permitted shall not be open to customers outside the following times:- 15:00 hours to midnight Monday to Sunday The reason for the condition is :- To protect the amenities of the adjacent residential occupiers.
4.The use hereby permitted shall not commence until fume extraction and odour control equipment has been installed in compliance with a scheme to be submitted to and approved in writing by the Local Planning Authority. The approved equipment shall thereafter be retained in perpetuity and operated and maintained in accordance with manufacturer's instructions and be operated at all times when cooking is carried out. The reason for the condition is :- To maintain the visual amenities of the area and ensure that local residents are not disturbed by smells and noise.
5.The flood response plan recieved by the Local Planning Authority on the 9 December 2015 shall be displayed within 204 Northgate Street in perpetuity unless otherwise agreed in writing within the Local Planning Authority. The reason for the condition is :- To ensure the flood response plan is available to occupiers of the property.
6.REASON FOR APPROVAL OF THE APPLICATION :- The proposal meets the criteria outlined in policy SHP4 and SHP15 of the Borough Wide Local Plan and policy CS7 of the Core Strategy.
